Special rental conditions / rental contract with Customers 2026-2028

General information

The contract is signed on the basis of tourist accommodation.

Therefore, guests may not use the properties as a principle or secondary place of abode. They must not carry on any commercial, craft or professional business there. The Law of 6 July 1989 concerning housing leases may not be applied to the contracts agreed between Chalets Cocoon and the Customers in particular with regard to maintaining the premises.

Consequently, the contract will be governed by the provisions of the Civil Code, the Tourism Code, the Consumer Code as well as the conditions stipulated herein.

Absence of right of withdrawal

In accordance with article L121-21-8 of the Consumer Code, the right of withdrawal is not applicable to services concerning accommodation, transport, dining, leisure which must be provided on a date or in accordance with an agreed period.

Sales offer

The Chalets Cocoon catalogue and web site constitute a preliminary offer within the meaning of articles R. 211 – 5 and R. 211- 6 of the Tourism Code. Chalets Cocoon reserves however the option to change some of the services offered, in accordance with the conditions stipulated under article R 211-6 of the Tourism Code. The booking of a stay and/or a journey implies the acceptance of these special rental terms and conditions. Variations in economic conditions may require Chalets Cocoon to modify prices before the contract is signed. We draw your attention to the deformation in appearance that the buildings, bedrooms and swimming pools will have if wide angle photos are taken. The photos are provided merely as examples and are under no circumstances contractual. The surface areas of the properties are given on an indicative basis. Chalets Cocoon may not be held liable in respect of any building or development work undertaken by the municipalities or by individuals in the vicinity of the residence

Prices

Stays are all on the basis of the prices which are current when the booking is registered. All orders, regardless of origin, are payable in Euros. The prices are per property and per day or week, unless specially agreed otherwise.

Our prices are understood as being “Inclusive of VAT” and include Value Added Tax at the current rate. Any subsequent changes in the current rate of VAT or any creation of new taxes on the services listed in the catalogue, occurring between the time when the prices were set and the invoicing, will lead as of rights to a change of the price inclusive of VAT. The prices do not include: the registration fees, the fixed rate that might apply per week or per stay for your pet, the deposit you pay upon arrival and which is returned to you after your stay (subject to an inventory being carried out upon departure), any additional services that there may be and the tourist tax.

Promotions

Promotions and discounts are under no circumstances retroactive.

Booking registration and confirmation

Upon payment of the deposit and confirmation by Chalets Cocoon of the reservation, it becomes firm and final and is subject to these general rental conditions.

Payments and invoices *

The first deposit, 25% of the rental amount, is payable by secure credit card payment on the booking system on the Chalet Cocoon website.

The second payment of 25% of the rental amount will be requested 90 days before the day of arrival.

The balance of the stay will be requested 45 days before the day of arrival. 

For any bookings made 45 days before the date of arrival, the booking must be paid in full in order to be confirmed.

* For reservations made directly on the Chalets Cocoon website, the 2nd and 3rd payment will be automatically debited from the same card used for the initial payment.

The prices include:

The rental of the fully equipped apartment (sauna, jacuzzi, home appliances), bed linen, bathroom towels, bathrobe and welcome products.

The EP TV and WiFi internet access.

Wood for apartments with a fireplace.

Water and electricity.

Cleaning at the end of the stay (except kitchen area, dishes and bins).

Mid-week cleaning included: change of towels (excluding bathrobe), floors in kitchen and living area, bins emptied.

Private Access to the swimming lane.

Ski lockers with boot dryer in the skiroom.

Tourist tax – Eco recycling participation

The tourist tax is not included in the rental prices shown below. The amount applicable is 3.96€ per night and per person aged 18 and over, which is paid in full to the local Mairie.  Guests will be required to pay this to Chalets Cocoon before departure. As appropriate, and based on the same operating principle, an Eco recycling tax, which is not included in the rates, may be collected for the protection of the environment and sorting of waste. To date, the municipality of Saint-Martin de Belleville has not introduced any such tax.

Baby Kit

Guests are strongly advised to reserve a baby kit when booking. (free of charge)

Parking

Chalets Cocoon has 19 private, interior, secured parking places in P0 (150m). If required guests are strongly advised to book places with Chalets Cocoon when making their reservation.

Leisure

Information about in-resort activities advertised on www.chaletscocoon.com are suggestions which have been provided by Tourist Boards or external providers at a date well before the customer’s stay. For further information, guests are asked to directly contact the service providers before booking to check that these activities are still on offer.

CONDITIONS OF CANCELLATION

  • In the event of cancellation of a reservation more than 90 days before arrival, the following compensation conditions apply: 100% of the amount of the deposit is returned to the client.
  • In the event of cancellation of the stay, less than 90 days (i.e. from 89 to 45 days) before arrival, the following conditions apply: 100% of the amount paid as a deposit is retained by Chalets Cocoon (i.e. 50% of the rental price)

  

  • In the event of cancellation of the stay between 44 days and the day of arrival, the following conditions apply: – 100% of the rental price is retained by Chalets Cocoon.

Customers who have not paid the balance 45 days before the date of arrival are considered as having cancelled their stay without them being able to claim any compensation. In addition, the accommodation may be re-rented at will. The cancellation fees are then applied in accordance with the cancellation conditions listed above.

CANCELLATION CONDITIONS DUE TO A DECISION BY A NATIONAL FRENCH ADMINISTRATIVE AUTHORITY OR FROM THE CUSTOMER’S COUNTRY OF ORIGIN

“Travel Restriction” option: Public rate + 4% non-refundable fees

For an additional 4% of the amount of the stay (payable at the time of booking) the ‘Travel Restriction’ allows you to cancel if government travel restrictions make it impossible for you to travel from your place of residence to Val Thorens (proof required) and to be fully reimbursed for the amount of the reservation (excluding 4%). If the reservation is postponed, the 4% charge will be canceled or postponed. In the event of regulatory measures taken during the stay leading to an early return to the customer’s residence, the nights not used will be reimbursed.

• Closure of French borders or the borders of the client’s country of residence.

• Over 48hr compulsory confinement upon the client’s arrival in France or over 7-days compulsory confinement upon return to client’s country of origin.

• Travel restrictions

• Administrative closure of Val-Thorens ski lifts.

EXCEPTIONAL RATE DISCOUNT

If official government restrictions make it impossible to open Val-Thorens’ ski lifts during the clients stay the Low Season rate will be applied for any reservation other than the “Travel Restriction” option above. These restrictive measures must be in effect the day before the client’s arrival.

Interruption of the holiday:

If the holiday is cut short, the client will not receive any refund unless he has bought a private cancellation insurance which covers the client’s particular case.

Transfer of contract

In the event of the transfer of the contract by a client, the client must inform Chalets Cocoon by any written means for which receipt can be acknowledged, at least 7 days before the beginning of the stay. The client must indicate the contact details of the new beneficiaries and make sure that they fulfill the same conditions as the client in order to stay at the premises. Chalets Cocoon reserves the right to refuse the transfer.

Curtailment of stay

The client may not claim any compensation or refund if he shortens or interrupts his stay for any reason whatsoever which is not attributable to Chalets Cocoon. Any unused services will not be refunded. Chalets Cocoon shall under no circumstances be required to refund to the client tenant the rent corresponding to the period between his premature departure and the date scheduled for the end of the rental.

Reception and check-in

Guests should report to the reception lobby which is located at Chalets Cocoon, 77 Rue des Balcons, Val Thorens, 73440 Les Belleville, 3 Vallées, Savoie, France.

The client agrees to take possession of his accommodation on the scheduled date during reception hours. Should these conditions not be satisfied, Chalets Cocoon is entitled to refuse to hand over the keys and may re-rent the apartment within 24 hours.

The properties are available to the client from 5 pm. On the day of departure, they must be vacated at 10 am at the latest, with the customer undertaking to follow the instructions referred to under the article “cleaning” below. In the event of a later departure which was not agreed with the manager of the residence, a flat rate surcharge of €300 / additional hour will be charged to the client. Any hour started will be charged in full.

In the event of a late arrival, during the hours when reception is closed, the client must inform the Chalets Cocoon Manager beforehand so that check-in procedures can be organised. The client must report to the reception no later than the next morning after his arrival in order to perform the check-in procedures.

Nationals, citizens of the EU or non-EU citizens

Chalets Cocoon reminds clients that they must be able to prove their identity in particular upon arrival. Otherwise, Chalets Cocoon may deny them access to its premises.

Stock-take, inventory, cleanliness and damages

Any complaints regarding the inventory, stock-take and equipment, or the cleanliness of the apartment must be made to reception within 24 hours of arrival. After this deadline guests will be considered as having automatically acknowledged the accuracy of the inventory, the stock-take and equipment and the cleanliness of the property.

Guests must report any damages or breakages which have occurred during their stay to reception.

None of the items which are part of the property are to be removed or moved to another property. Any item removed or transferred to another property will be considered as missing and the corresponding value deducted from the security deposit.

The tenant will be responsible for the items contained in the chalet or apartment and will be required to pay for the missing or damaged items at their price, or for them to be repaired or cleaned, in particular the bedding.

In the event of damage to the premises (walls, ceilings, paintings, sanitary facilities, or other), the tenant will be asked by Chalets Cocoon to be present for the verification of the damages and for making any comment which will be indicated in the inventory statement. For any clear damage that is found, the client will be required to pay for repairs, in accordance with the assessment made by the repairer at the request of Chalets Cocoon.

Cleaning

The end of stay clean is included in the rental. However, the client must leave the accommodation in a suitable state, and comply with the following instructions:

-Furniture in its place

-Refrigerator, dishwasher, Dustbins emptied.

-Dishes and Kitchen, cleaned and tidied.

Where this has not been respected an amount corresponding to the tidying and cleaning costs will be deducted from the security deposit and charged to the client.

Security

Customers must make sure that they close the doors and windows of their property when they are absent. Under no circumstances may Chalets Cocoon be held liable in the event of theft without break-in.

Similarly, they must not leave any objects or equipment on the patio/balcony of their property or in the communal areas of the residence and they must ensure that their ski locker is locked. Should they fail to follow these instructions Chalets Cocoon may under no circumstances be held liable.

Children under the age of 18 are under the sole and full responsibility of their parents or accompanying adults for the duration of their stay, and this applies also to the use of the various facilities and equipment (sauna, hot tub, swimming pool,) which must be used under the full responsibility of an accompanying adult. Clients are informed that “the use of top bunk beds is unsuitable for children under six years”. This warning appears on all bunk beds in a legible, visible and indelible manner (article 6 of the Decree No. 95-949 of 25 August 1995).

Children under the age of 18

Children under the age of 18 remain the responsibility of their parents and/or accompanying adult for the duration of their stay on the premises. Chalets Cocoon may only complete the booking of a stay for children under the age of 18 if they are under the responsibility of an accompanying adult.

Occupancy/number of persons authorised in the property

Each property will be provided to the customer in a good state of cleanliness and repair. All the properties which are presented to customers comply with French safety standards and are properly equipped for tourist stays. The description of each property specifies the maximum number of people allowed.  Fold down bunk beds are only for people aged 6yrs – 18yrs. Any breach of this rule will result in a penalty being charged of €1500 per extra adult present in the property. All this shall be without prejudice to any other damages and interest.

Internal rules

In order to protect the tranquility of all those staying in the building, the internal rules on proper behaviour are displayed in the residence. Customers are required to familiarise themselves with these rules and to comply with them. For your information, all of the accommodation is non-smoking.

Pets

Pets, with the exception of those which are non-domestic (exotic…), are allowed subject to the prior agreement of Chalets Cocoon and at a surcharge of €150/week to be paid by the client on departure. It is recommended that the client contacts Chalets Cocoon directly to make sure that pets are allowed as well as the terms governing their stay. Their presence must under no circumstances cause a nuisance to neighbours (noise, hygiene, smell…), Pets are strictly prohibited in the vicinity of swimming pools, paddling pools or other facilities of the same type (Jacuzzi, sauna…). Dangerous or aggressive pets as well as so-called “new lifestyle pets” are not allowed. The client must be in possession of the pet’s health record.

Security deposit/ guarantee

The tenant is required to give a preauthorisation deposit on VISA or MASTERCARD ranging from €1500 to €3000 depending on the property capacity.

The residence will return the deposit after checking the condition of the property and after taking possible deductions for any damage that may have been caused to the property and/or to the communal areas; any outstanding balance; provided that the internal rules of the residence have been fully complied with.

Early termination of the contract due to customer breach

The contract can be terminated without the need to go to court in the event of the client not respecting obligations or through conduct which is likely to disturb other guests or disrupt the operation of the tourist residence.

In this case, the client shall immediately return his keys and may be required to leave without notice. In the event of complaints regarding excessive noise after 10 pm and after two warnings by residence managers have remained unheeded, Chalets Cocoon reserves the right to keep the deposit paid by the client and/or to have the client expelled from the property with the help of the police.  This expulsion will definitively end the customers’ stay without any compensation being payable.

Responsibility

The client is informed that, in accordance with current legislation, the sale of tourist stays is not part of the responsibility of the hoteliers. Consequently, Chalets Cocoon may not be held liable in the case of loss, neglect, theft of or damage to personal effects in particular in the property, communal premises and adjacent car parks. The client is responsible for the security of his accommodation during his stay and as a result it is up to him to have the necessary insurance. In particular the patio doors should be closed before leaving the premises, and the front door of the property should also be locked. A safe is available in each apartment.

Claims

All claims must be made by registered letter within 30 days following the stay to:

Disputes, amicable or court ordered settlement

The parties shall make every effort to resolve their disputes amicably with the client, undertaking to approach Chalets Cocoon beforehand as is stated under the article “Claims” above.

Should the parties not be able to resolve their dispute amicably, the client is informed that it may use traditional mediation, in particular with the Commission for consumer mediation (C. consumer art. L534 – 7) or with the industry mediation authority of which the Residence Operator is a member or any alternative means for settling disputes (conciliation…). The client may find the necessary information on the site www.mediation-conso.fr Any application by the client to a mediator must contain the following details so that it can be processed quickly: his postal, email and telephone contact details as well as the full name and address of the company Chalets Cocoon, a brief statement of the facts, and proof of the preliminary steps which have been completed. In the absence of an amicable settlement, any disputes arising from this contract, concerning both its validity, its interpretation, fulfillment, termination, their consequences and implications will be brought before the competent courts in accordance with the conditions of common law.

In the event of a dispute with professionals and/or traders, the courts in CHAMBÉRY (Savoie – France) shall have jurisdiction.
